Fight ACS Charges
ACS is required to open an investigation when the agency receives a report from the New York State Central Register (SCR) of Child Abuse and Maltreatment.
Reports of child abuse and neglect are made 24 hours a day, seven days a week by calling the New York State Central Register (SCR) Child Abuse and Maltreatment Hotline. All calls are confidential. ACS investigations begin when the SCR relays calls to ACS.
The SCR typically receives reports from mandated reporters. Mandated reporters include doctors, nurses, social workers, teachers, or the police. The SCR also receives malicious reports from anonymous sources like ex spouses or other family members, neighbors, or friends.
ACS investigations often begin with a phone call or an unannounced visit to your home – often at inconvenient times of the day.
Politely advise ACS workers that before your speak with them, you will call an attorney for legal advice. This is your right and should not be challenged. During ACS investigations expect the ACS worker to threaten you and become very rude when you inform them that you will not speak to them without a lawyer present.
The reason not to speak with ACS workers is simple. ACS workers do not record the interviews. This allows them to lie and manufacture facts that do not exist. All interviews with ACS should be recorded and in the presence of your attorney to ensure that ACS does not overstep its bounds and ignore your rights.
ACS investigations result in a report that will show as either “indicated” or “unfounded”. Indicated is bad, because you are required to appear in court to face charges, and you may be convicted of a crime. You can lose your children to foster care, and you may be required to take parenting classes. This outcome often results because parents do not consult with an ACS Lawyer from the start.
The better outcome for ACS investigations is unfounded. An unfounded report is the preferred outcome meaning ACS will not take further action. Unfounded reports are easier to achieve when you consult with a qualified attorney before speaking to ACS workers.
Thousands of families are put through years of ACS abuse because they ignore this advice and believe that they can reason with ACS. ACS case workers have no interest in fairness, they only want to make it appear that they are doing their jobs.

Recently, my beloved 1st daughter passed away unexpectedly in her crib. My wife and I woke up to see our beloved daughter unresponsive. This is def. the hardest time in our life.
